Terms of service
This is a translation of the Italian text, which prevails in case of doubt.
These terms govern your use of AI Tokens: the ai-tokens.it website, the dashboard (my.ai-tokens.it), the chat (chat.ai-tokens.it), the documentation (wiki.ai-tokens.it) and the API (api.ai-tokens.it). AI Tokens is a service of Internet One Srl, a single-member company, Via Piemonte 95, 21100 Varese, Italy, VAT no. IT02286170127, ROC no. 18429 ("we", "us"). Internet One Srl is your contracting party and issues the invoices.
1. Who the service is for
AI Tokens is a service for businesses, professionals and organisations, and for private individuals aged 18 or over. If you use the service for purposes outside your trade or profession, you are a consumer: in addition to these terms, you have the protections of the Codice del Consumo (Italian Consumer Code, Legislative Decree 206/2005), and no clause in these terms limits them.
2. The service
AI Tokens gives access to open-weight AI models through an OpenAI-compatible API and through the chat. You pay for what you use, with prepaid credit.
The models, the machines each one runs on, the country and the prices are listed on ai-tokens.it, on the Models page of the dashboard and in the documentation. The catalogue is still changing. A model or one of its variants may be slow or unavailable for some time, for example during maintenance or after a fault.
- Model and machine. If you give only the model name, we choose a machine that serves it. With
model@hardwareyou choose the machine; if it is not available, the request is rejected and nothing is charged. - The
automodel. We choose the model for each request, as described in the documentation. You pay the rates of the model that answers, which is stated in the response. - Limits per key. In the dashboard you can restrict each key to one country and set a monthly spending limit for it. A request whose maximum cost exceeds what remains of the limit is rejected before any model starts.
3. Your account
- Accounts are opened on request: write to info@internetone.it. We may ask for your company details and may refuse a request without having to give reasons.
- You are responsible for everything done with your account and your API keys (they start with
sk-ait-), including by your employees and contractors. Keep your keys as safe as a password and do not put them in code you share. If a key leaks, revoke it at once on the API keys page and let us know.
4. Credit, prices and invoices
- Prepaid credit in euros. Requests are paid from your credit balance.
- How to top up. By card, on the Billing page of the dashboard, from €10 to €5,000 at a time, plus VAT. Payment is processed by Stripe and the credit is added as soon as Stripe confirms it. For larger amounts or to pay by bank transfer, write to info@internetone.it.
- Invoices. For each top-up we issue an electronic invoice through SdI (the Italian e-invoicing system), using the billing details you enter on the Account page before paying. Stripe also sends you a receipt by e-mail.
- Extra credit. A top-up may include additional credit, as shown on the Billing page before you pay. Extra credit is used in the same way as paid credit, but it has no cash value and is not refundable.
- Automatic top-up, if available and if you turn it on: you authorise us to charge the card saved with Stripe the amount you choose each time your credit falls below the threshold you choose. You can change it or turn it off at any time on the Billing page. If a charge fails, it turns off and we notify you by e-mail.
- Prices. Per model, in euros per million tokens, with separate prices for input and output tokens. Input tokens cost the model's list price on every machine; output tokens cost the list price multiplied by the factor of the machine that answers. If a request's prompt is over 32,768 tokens, its input costs 1.5 times the list price; over 131,072 tokens, 2 times. Audio, images and video are priced per unit. The price that applies is the one published when you send the request.
- VAT. List prices exclude VAT. VAT, currently 22%, is added when you top up: the payment page shows the total, including VAT, before you confirm. If you are a business established in another country of the European Union, write to us before topping up.
- Reasoning. Tokens a model uses to reason before answering count as output tokens.
- How we count. Each request is charged according to the number of tokens reported by the model. A response that you interrupt, or that stops after the text has started, is charged for the tokens used; if the model did not report them, we estimate them at about four characters per token. A request rejected before a model starts to answer costs nothing. The cost of each request, with the machine that answered, is shown on the Usage page of the dashboard.
- Balance. A request starts only if your balance is above zero. The last request may take it slightly below zero: the difference is deducted from your next top-up.
- Paid credit does not expire. It is not refunded, except where we do not provide the service, in the cases set out in sections 5 and 12, or as required by law. If you delete your account, the balance is deleted with it: before you do so, ask us to refund any credit you are entitled to.
5. Consumers' right of withdrawal
If you are a consumer, you may withdraw from a top-up within 14 days of payment, without giving any reason, by writing to info@internetone.it or by PEC (certified e-mail) to internetone@pec.it. You may use the form in Annex I, Part B, of the Codice del Consumo, but you do not have to. Within 14 days we refund the part of the top-up you have not yet used, by the same means of payment.
When you pay, you ask us to start at once: the credit can be used as soon as it is added. Credit you use within the 14 days remains payable (art. 57(3) of the Codice del Consumo).
6. Where requests are processed
The models run on machines in Italy and Switzerland. The country of each variant is shown in the price list and in the X-Zona header of every response. If you restrict a key to one country, we never send its text requests outside that country: if the model does not run there, the request is rejected and nothing is charged. Accounts, keys, logs and documents are kept on our servers in Switzerland. The privacy policy explains the details.
7. Acceptable use
You may not use AI Tokens to:
- produce or distribute content that is unlawful under Italian law or the law of your country, such as material that sexualises minors, incitement to hatred, fraud or copyright infringement;
- produce disinformation, defamation or deepfakes of real people without their consent;
- engage in practices prohibited by art. 5 of Regulation (EU) 2024/1689 on artificial intelligence (the AI Act);
- attack or overload the service, circumvent its limits or content controls, or attempt to extract model weights;
- share or resell access to your account or your keys without our written agreement;
- process other people's personal data without a legal basis.
Requests for images, video and voice may be checked automatically by one of our models before any content is generated. Images and video are checked again before delivery. A request that fails the check is rejected.
If you offer your users a system built with AI Tokens, the obligations that Regulation (EU) 2024/1689 places on whoever puts it into service, such as informing people that they are talking to an AI system, are yours.
8. Your content and the responses
Your requests, files and conversations remain yours. We do not use them to train models. The responses generated by the models are yours, to the extent permitted by law.
Models make mistakes, even when they seem confident. Check responses before relying on them, especially numbers, dates, quotations and code. Medical, legal or financial matters need the judgement of a professional.
Each open-weight model is published by its developer under its own licence: comply with it when you use the model and its responses.
9. Personal data you send us
If your requests, files or conversations contain personal data of other people, you are the controller of that data and Internet One Srl is its processor under art. 28 of the GDPR. This section is our agreement on that processing.
- We process that data only to provide the service to you and on your instructions, which are these terms and the settings you choose in the dashboard.
- Anyone who processes it on our behalf is bound by confidentiality.
- The security measures are those set out in section 8 of the privacy policy.
- You authorise us to use the sub-processors listed in the privacy policy and on the sub-processors page of the documentation. We notify you by e-mail at least 30 days before adding one: you may object. If we cannot find a solution, you may close your account and receive a refund of any paid credit you have not used.
- We help you respond to requests from data subjects and comply with arts. 32-36 of the GDPR, as far as our service is concerned.
- If we become aware of a breach affecting that data, we notify you without undue delay.
- When the account is deleted, we erase that data within the periods set out in section 7 of the privacy policy.
- We give you the information needed to demonstrate compliance with these obligations. An on-site audit must be agreed in writing, with reasonable notice.
10. Liability
We provide the service with professional diligence, but without any guarantee that it will work without interruptions or errors, or that the responses will be correct or fit for a particular purpose. For now there is no service level with penalties: if you need one, we will agree it in writing.
Except in cases of wilful misconduct or gross negligence, and subject to mandatory rules, including those of the Codice del Consumo for consumers, our total liability is limited to the amount you paid us in the 12 months before the event that caused the damage. We are not liable for indirect damage, loss of profit or loss of data, nor for damage caused by force majeure, by network or power suppliers, or by use of the service in breach of these terms.
You will indemnify us against third-party claims arising from the content you send us or from your use of the service in breach of these terms.
11. Suspension and termination
We may suspend the service, or an account, for security reasons, for maintenance or if these terms are not complied with. If we suspend or close your account for a breach, we tell you the reason by e-mail. If the breach is serious, or is not remedied within 5 days of our notice, we may terminate the contract under art. 1456 of the Italian Civil Code.
You may delete your account at any time, with your password, on the Account page of the dashboard. The account is deactivated at once and you have 30 days to change your mind. The privacy policy explains what is deleted and when.
12. Changes
We may change these terms, the prices and the model catalogue. We inform you by e-mail at least 30 days before a price increase, the withdrawal of a model or a change to these terms that limits your rights. If you do not accept the change, you may close your account before it takes effect and we refund any paid credit you have not used.
Changes that do not affect your rights, such as corrections and clarifications, apply from when we publish them. The date at the top shows when this version came into force. Service updates are listed on the Service updates page.
13. Governing law and jurisdiction
These terms are governed by Italian law. For consumers, the competent court is that of the place where they reside or have their chosen domicile; a consumer resident in another country of the European Union keeps the mandatory protections of the law of that country. In all other cases, the courts of Varese have exclusive jurisdiction.
If you are a consumer, you may also turn to an alternative dispute resolution body (arts. 141 et seq. of the Codice del Consumo).
